Part II Order Request - Update
Class EA for Stormwater Drainage Improvements – London Road Corridor
1.0 General
In October 2010, following the mandatory 30 day review period associated with the Notice of Study Completion, two Part II Order requests were received from members of the public. The first was submitted by Jennifer Meader on behalf of Arnold and June Meader and was primarily concerned with the distribution of costs associated with the project. The second request was submitted by Brad Voisin, Gitta Voisin, Heidi Salvador and Tom Armstrong. This request was primarily concerned with impacts to the drain and downstream erosion near the outlet at Lake Huron.
2.0 Ministry Submission
With the assistance of Township staff, a response to the Part II Order request was submitted to the Ministry of the Environment, Environmental Assessment and Approvals Branch (EAAB) on November 18, 2010. The submission included individual responses to each concern expressed by the requesters in their letters to the Ministry of the Environment. Over the next several months, additional information was requested from Ministry staff to further clarify drainage problems in the London Road area of Port Albert and other details associated with the Class EA process.
3.0 Ministry Response
On March 25, 2011 correspondence was received from the Minister of the Environment indicating that the Part II Order requests had been denied. Copies of letters sent to the requesters, from the Minister, were also provided to the Township for their information (attached).
The Minister’s response confirmed commitments made by the Township in association with the Class EA process and noted that these commitments must be implemented as proposed in the Class EA Screening Report. Specific commitments noted by the Minister are 1) initiating a Drainage Act process to update the Port Albert Drain and revise the boundaries of same to include the existing outlet to Lake Huron, and 2) to monitor the condition of London Road following completion of construction and increase snow removal activities if it is deemed necessary.
Due to concerns raised through the appeal process, additional conditions were imposed by the Ministry as follows:
1) A number of documents submitted to the MOE in conjunction with the Part II Order request must be forwarded directly to the requesters and made available for public review at the Township Municipal Office and on the Municipal website.
2) Should human remains or culturally significant artifacts be discovered during construction, the Township must cease all work in the vicinity of the discovery and notify the Ministry of Tourism and Culture immediately.
The Township is now free to proceed with implementation of the project, subject to any permits and approvals that may be required.
