CORPORATION OF THE TOWNSHIP OF
ASHFIELD-COLBORNE-WAWANOSH

By-Law No. 21-2001

Being a By-Law to regulate road activities in the Township of

 Ashfield-Colborne-Wawanosh.

 WHEREAS the Municipal Corporation of the Township of Ashfield-Colborne-Wawanosh considers it advisable to regulate the roads within its jurisdiction.

 AND WHEREAS Section 73 of the Public Transportation and highway Improvement Act, Revised Statutes of Ontario, 1990, permits a Township to pass by-laws for specific road improvements and also for such purposes or road improvements as the Minister approves:

 Subject to the Ministers approval

 NOW THEREFORE the Council of the Corporation of the Township of Ashfield-Colborne-Wawanosh ENACTS as follows:

 1.      ENTRANCEWAYS

 The maintenance and gravelling of all original entranceways from private property to Township roads are the responsibility of the property owners.  The Township of Ashfield-Colborne-Wawanosh agrees to provide grade “A” gravel to the main entrance if the adjacent Township road grade is changed due to Township road construction.  The Township further agrees to supply grade “B” gravel on any existing additional laneways if the adjacent Township road grade is changed due to Township road construction, unless there is a minimum depth of 6” of grade “A” gravel on the secondary entranceways.

 Construction and alterations.

 All construction and alterations of entranceways and accesses to Township roads require the issuance of an access permit and/or permission of the Public Works Superintendent or Lead Hands.

 2.      ROAD CONSTRUCTION 

a)      In connection with any road construction, the Township agrees that topsoil will be sloped to the shoulders of the road and additional topsoil will be provided at the discretion of the Public Works Superintendent or Lead Hands.

b)      The height of a constructed road will be determined by the Public Works Superintendent or Lead Hands and will vary in accordance with Municipal Standards.

c)      Existing paved driveways that are covered up with gravel at the time of construction will be repaved when pavement is applied to the Township road.

 3.      DRAINAGE TILE, ETC. UNDER TOWNSHIP ROAD ALLOWANCES

 All excavations across or under Township road or road allowances must be authorized by the Public Works Superintendent or Lead Hands before such work commences.  The property owner is responsible for a minimum of 30 ft of steel culvert, gravel backfill, installation and digging across Township road or road allowance.

 4.      PLANTING OF HEDGES, TRESS and WINDBREAKS

 All coniferous trees, hedges and windbreaks must be situated a minimum of 20 feet from Township road allowance property line. 

 5.      PROPERTY OWNERS’ LANEWAYS

 Property owners’ laneways will not be maintained by the Township and Township equipment should not leave Township property except in cases of emergencies or if authorized by the Public Works Superintendent or Lead Hands.

6.      FENCE LINES AND DEBRIS ON TOWNSHIP ROAD ALLOWANCE

Fence lines and debris on Township Road Allowance will be removed if causing snow problems as long as the property owner is in agreement.

7.      TREES, BRUSH AND DEBRIS

      Trees, brush and debris that restrict road construction or maintenance will be removed if on road allowance.  Trees and brush that overhang onto road allowance and endanger the safety of the public will also be removed.

 8.      MANURE, ROCKPILES, BRUSH AND DEBRIS

Manure, rock piles, brush and debris will not be permitted on the road or road allowance.  Removal of such debris will be the property owners responsibility.  If debris is not removed within a limited time period, the Township will arrange for removal and the property owner involve will be billed for the cost.

9.  CALCIUM

Calcium shall be provided to control dust on the roads according to traffic volume and will be left to the discretion of the Public Works Superintendent or Lead Hands.

 10.  MAILBOXES

 Mailboxes that are damaged by snow coming off of Township equipment will be the property owners responsibility.  If there is sufficient evidence that the Township equipment came in direct contact with the mailbox, then the Township shall be liable for damage at the discretion of the Public Works Superintendent or Lead Hands.

 11.  Every person who uses the roads in a manner contrary to any requirements of this by-law, or who violates any provision of this by-law, is guilty of an offence and upon conviction thereof is liable to a fine not exceeding $5,000.00.  Every such penalty shall be recoverable under the Provincial Offences Act, R.S.O. 1990.
