
CORPORATION OF THE TOWNSHIP OF
ASHFIELD-COLBORNE-WAWANOSH
By-Law No. 45-2003
Being a By-Law to Provide Drainage and Flood Control.
WHEREAS the Municipal Act, 2001 provides that the council of a local municipality may pass by-laws to regulate drainage and flood control;
NOW THEREFORE the Council of the Corporation of the Township of Ashfield-Colborne-Wawanosh hereby ENACTS as follows;
In this by-law;
(a) "Council" shall mean the Council of The Corporation of the Township of Ashfield-Colborne-Wawanosh;
(b) "Control Works" shall mean structures of any nature and kind within the geographical boundaries of the Township necessary for or designed to regulate the water table or water level within or on any lands or to regulate the level of the waters of a drain, reservoir, lake or pond and includes a berm, dam, embankment, wall, protective works or any combination thereof;
(c) "Township" shall mean The Corporation of the Township of Ashfield-Colborne-Wawanosh;
The Township may install, construct, alter, repair or maintain such control works as Council may direct from time to time for the purpose of promoting and improving drainage and flood control within the Township.
Every person who interferes with, obstructs, alters, or removes a control works installed, constructed, altered, repaired or maintained pursuant to this by-law is guilty of an offence and upon conviction is liable to the maximum fine prescribed in the Provincial Offences Act.
In the event any person interferes with, obstructs, alters or removes a control works installed, constructed, altered, repaired or maintained pursuant to the by-law, the Township may restore the control works at such person’s expense and recover the costs by adding the costs to the tax roll and collecting them in the same manner as municipal taxes.
If this by-law is contravened and a conviction entered, in addition to any other remedy and any penalty imposed by this by-law, the court in which the conviction has been entered and any court of competent jurisdiction thereafter may make an order prohibiting the continuation or repetition of the offence by the person convicted.
This by-law shall take effect and be in force on the day that it is passed.
