THE CORPORATION OF THE TOWNSHIP OF
ASHFIELD-COLBORNE-WAWANOSH
BY-LAW NUMBER 59-2002
BEING A BY-LAW TO REGULATE THE TIME, MANNER AND EXTENT AND NATURE OF THE SUPPLY OF WATER WITHIN THE TOWNSHIP WHICH RECEIVE WATER FROM THE TOWNSHIP OF HURON-KINLOSS
WHEREAS it is provided by Section 12 of the Public Utilities Act, R.S.O., 1990, C. P.52, that the Council may pass by-law for regulating the time, manner and extent and nature of the supply of water within the township in order to secure the inhabitants of the township with a continued and abundant supply of pure and wholesome water and to prevent the practicing of frauds upon the Township with regard to the water so supplied;
NOW THEREFORE the Council of The Corporation of the Township of Ashfield-Colborne-Wawanosh enacts as follows:
1.0 No one on Municipal water provided by the Township of Huron-Kinloss shall water their lawns and gardens except in compliance with this By-Law.
2.0 This by-law shall be effective from June 1st to September 15th in each and every year.
3.0 Subject to the provisions of this By-Law lawns may only be watered between the hours of 4:00 p.m. and 10:00 p.m. local time.
4.0 Residents affected will be permitted to water lawns and gardens of municipally even numbered properties on even numbered days of the month.
5.0 Residents affected will be permitted to water lawns and gardens of municipally odd numbered properties on odd numbered days of the month.
6.0 This by-law shall not apply to newly installed or planted lawns for a period of 30 days from the first installation or planting of said lawn.
7.0 This By-Law shall not apply to hand held hoses.
8.0 Every person who contravenes any provisions of this By-law:
(i) is guilty of an offence; and,
(ii) upon conviction therefore is liable to a fine or penalty of not more that Five Thousand ( $5,000.00 ) Dollars as prescribed in The Provincial Offenses Act, R.S.O. 1990 c. P.33, as amended.
9.0 This By-Law applies to South Amberley Beach Area, Amberley Area, Lucknow/Wawanosh Area and Lucknow/Ashfield Area.
10.0 This By-law may by cited as the "Lawn Watering By-Law for Huron-Kinloss".
