CORPORATION OF THE TOWNSHIP OF
ASHFIELD-COLBORNE-WAWANOSH

By-Law No-22-2001

Being a By-law to regulate abandoned vehicles on the roads of the Township of Ashfield-Colborne-Wawanosh within its jurisdiction
 

WHEREAS the Municipal Corporation of the Township of Ashfield-Colborne-Wawanosh considers it advisable to pass a by-law to regulate abandoned vehicles on the roads within its jurisdiction.

 AND WHEREAS Section 210, sub-section 131, of the Ontario Municipal Act, Revised Statutes of Ontario, 1990, permits a municipality to pass a by-law prohibiting the parking or leaving of motor vehicles on property occupied by the municipality and to provide for the removal or impounding of any vehicle at its owner’s expense, parked or left, contrary to the by-law.

 NOW THEREFORE the Council of the Corporation of the Township of Ashfield-Colborne-Wawanosh ENACTS as follows:

 1.      ABANDONED VEHICLES

a)      No person shall park or leave motor vehicles that are in a wrecked, discarded, dismantled, unlicensed, inoperative or abandoned condition on the Township road or road allowance and any such vehicle that are left and are hindering road maintenance shall be towed away and impounded at the owner’s expense. 

b)      Every person who contravenes section 1 a) is guilty of an offence under section 321 of the Ontario Municipal Act, Revised Statutes of Ontario, 1990, and on conviction is liable to a fine of not more than $5,000.00.  Every such penalty shall be recoverable under the Provincial Offences Act, R.S.O. 1990.
